Aggressive driving is any expression of aggression by a driver. Another term for it is road rage. In its extreme form, aggressive driving results in the use of the vehicle as a weapon or physically assaulting the other driver. If this occurs, then it is no longer road rage. You go from being charged with a serious moving violation to being charged with a very serious violent crime.

Most local police describe aggressive driving as a behavior where the driver of a motor vehicle is engaging in a driving behavior without regard for the rights or safety of the other people on the road.

Many states have now enacted laws to combat road rage. The legislature calls it one of the following: Aggressive Driving, Improper Driving or Careless Driving. The general consensus of law enforcement in urban and suburban localities is that aggressive driving is increasing. Every year there are more and more cars on the roads. Unfortunately, the number of roads in these localities have not kept pace with the growth. There is more and more demands on a person's time. People have to get to work on time, pick up their children from day care, etc. One study that took a poll of what were some of the safety threats on the roads, determined that aggressive driving to be a major threat.

Another study determined that people who were most likely to engage in aggressive driving were drivers between the age of 18 to 26, males who were not highly educated with criminal records, a history of violence, drug or alcohol problems. However, other studies have determined that many of those convicted of aggressive driving were men and women who were successful with no history of violence, drug or alcohol abuse. Additionally, a number of people who were convicted of aggressive driving were between 30 and 55 and some were as old as 75. A series of bad driving incidents can cause a person to engage in aggressive driving.

Some of the most common types of aggressive driving behavior police look for are:

  • Aggressive tailgating
  • Lights flashed at them because the other motorist was annoyed
  • Aggressive or rude gestures
  • Deliberately obstructed or prevented from moving their vehicle
  • Verbal abuse
  • Physically assault

You could be charged with aggressive driving if you do any of the following:

  • Flashed lights at another motorist because they were annoyed with them
  • Make aggressive or rude gestures
  • Engage in yelling, screaming or verbal abuse towards another motorist.
  • Aggressively tailgate another motorist
  • Deliberately obstruct or prevent another from moving their vehicle

Most of the aggressive driving violations occur during daytime on a major road.
