MEDIATION VIRGINIA MARYLAND CHILD CUSTODY VISITATION SUPPORT

MEDIATION – CHILD CUSTODY, CHILD VISITATION & CHILD SUPPORT IN
VIRGINIA AND MARYLAND

Many parents in Virginia and Maryland are choosing to use Mediation to resolve their child custody, child visitation, and child support issues as an alternative to going to Court. They are finding that not only is Mediation less costly than litigating their matter, it takes less time. Perhaps one of the most attractive aspects of Mediation is self-determination.

Mediation can be used whether the issue is new – there has never been a custody, visitation, or support agreement or Order, or whether the parents would like to modify an existing agreement or Order. Many times, agreements and Orders will contain a provision requiring that the parents attempt to Mediate prior to returning to court.

COST: Mediators and attorneys alike will require a retainer and will charge hourly for their services. As opposed to each party hiring and paying their own attorneys, when Mediating, the parties will share the cost of the Mediator. When they agree to Mediate, the parties also agree to full disclosure of all relevant information. As a result, the parties avoid the cost of doing discovery to obtain necessary information from the other party. Typically, most people underestimate the cost of litigating their case and find once they start down the road to litigation, the expense becomes overwhelming. While a majority of cases settle, the timing of the settlement makes a difference with regard to the expense of the case. Settling a case close to trial often results in a settlement under less than favorable conditions and with which the parties do not feel completely satisfied. And again, settling at the last minute, although better than not settling at all, means that you have already spent money for trial preparation. If the case settles earlier, as is usually the case when parties participate in mediation, the cost of trial preparation can be avoided altogether.

TIME: If parties cannot agree to a custody, visitation, or support arrangement, they head to court. In Virginia and Maryland, once a custody, visitation or and/or support petition is filed, the case is set on the court’s docket for a status hearing; this usually takes place within a month or so after filing. The status hearing is the first appearance before the court when the parties confirm with the Judge the issues to be addressed and the current status of the situation. The case may then be set for a pre-trail conference to take place in another month or more. Finally, the case is set for trial, and depending upon the time needed to properly present the issues, the trial may take place several more months down the line. Consequently, the case is not heard and the parties do not have a ruling until many months have passed. Mediating the same case normally takes only a fraction of the time.

SELF DETERMINATION: Even when parents have differences of opinions regarding custody, visitation and support, the parents are still the experts on their children. They know how their children will react and adjust to custody and visitation schedules, and they know the expenses associated with raising their children. The parents are in a better position to determine what is in the best interest of their children much more so than the Judge. During Mediation, the parties are not confined, as are Judges, and they have the freedom to be flexible and creative when arranging custody, visitation, and support. As opposed to having to comply with an arrangement which has been dictated to you by the Court, it is much easier and more comfortable to live according to a custodial schedule or child support arrangement that you are responsible for crafting; that you know will be manageable for all involved, and which will allow all members of your restructured family to move forward successfully.
